Recent discussions within the market have raised concerns regarding the use of unlicensed overseas insurers. Specifically, MGAs that underwrite in the UK on behalf of overseas insurer principals who are not licensed to do business in the UK may inadvertently be bringing those insurers “onshore.” This practice is unlikely to comply with UK regulations unless the capacity provider has entered a fronting arrangement with a UK-authorised insurer.
